These Terms and Conditions ("Terms") govern your use of the Pantai Emas website (the "Site") and the residential advisory and property rental facilitation services offered by Pantai Emas Property Advisory ("Pantai Emas", "we", "us", "our"). By accessing this Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Definitions

Throughout these Terms, the following definitions apply:

• "Service" refers to residential property advisory, letting facilitation, and associated support services offered by Pantai Emas.
• "User" / "You" refers to any individual who accesses the Site or engages Pantai Emas services.
• "Client" refers to a User who has formally engaged Pantai Emas for property advisory or letting facilitation.
• "Property Owner" / "Landlord" refers to the individual or entity that owns the residential property being offered for rental.
• "Tenancy Agreement" refers to the formal letting agreement entered into directly between Client and Property Owner.
• "Agreement" refers to these Terms collectively with any specific engagement or service letter.

2. Acceptance of Terms

These Terms are formed upon your first access to the Site or upon your first formal enquiry to Pantai Emas, whichever occurs earlier. You confirm that you are aged 18 or above and have the legal capacity to enter into a binding agreement. Corporate users confirm that the individual accepting these Terms has authority to bind the relevant entity.

3. Nature of the Service

Pantai Emas is a residential property advisory and letting facilitation business operating in Kuala Lumpur, Malaysia. Our role is to:

• Provide advice on suitable residential properties based on Client requirements
• Facilitate viewings and introductions to Property Owners
• Assist in the preparation and exchange of tenancy documentation
• Provide post-tenancy support on a best-efforts basis

Pantai Emas is not a party to any Tenancy Agreement. All tenancy contracts are entered into directly between the Client and the Property Owner. Pantai Emas does not guarantee the condition, availability, or continued suitability of any property beyond the point of introduction.

4. User Responsibilities

When using this Site or engaging our services, you agree to:

• Provide accurate and complete information in all enquiries and application forms
• Not use the Site or services for unlawful purposes or in ways that infringe the rights of others
• Treat Pantai Emas staff, advisors, and property owners with courtesy and respect during all interactions
• Not reproduce, redistribute, or commercially exploit content from this Site without written permission
• Promptly notify us if circumstances affecting your eligibility or requirements change materially

5. Intellectual Property

All content on this Site — including text, photographs, layout, and design — is the property of Pantai Emas or its licensors and is protected under applicable Malaysian copyright law. You are granted a limited, non-exclusive, non-transferable licence to view and use the Site for personal, non-commercial purposes only. No content may be reproduced or used for commercial purposes without prior written consent.

6. Advisory Fees

Pantai Emas charges a facilitation fee for successful property placements. The fee structure applicable to your enquiry will be communicated in writing before any commitment is made. Fees are due upon successful execution of a Tenancy Agreement unless otherwise agreed in writing. All fees are stated in Malaysian Ringgit (RM) and are subject to any applicable tax under Malaysian law.

7. Tenancy Terms

Tenancy agreements, deposits, rental terms, and notice periods are governed by the agreement reached between Client and Property Owner. Pantai Emas facilitates but does not guarantee specific terms. Security deposits are typically equivalent to two months' rent and are held by the Property Owner in accordance with standard Malaysian practice. Pantai Emas is not responsible for the return or retention of deposits, which are governed by the Tenancy Agreement and applicable Malaysian tenancy law.

8. Disclaimers

Pantai Emas makes reasonable efforts to ensure that property information on this Site and in our communications is accurate and current. However:

• Property availability, pricing, and specifications are subject to change without notice
• We do not warrant that the Site will be available without interruption or free from errors
• Information provided is for general advisory purposes and does not constitute legal, financial, or investment advice

The Site and services are provided "as is" and "as available". To the fullest extent permitted by Malaysian law, Pantai Emas excludes all implied warranties, representations, and conditions not expressly stated in these Terms.

9. Limitation of Liability

To the extent permitted by applicable Malaysian law, Pantai Emas shall not be liable for any indirect, incidental, consequential, or special losses arising from your use of the Site or services. Our total aggregate liability to any Client shall not exceed the facilitation fee paid by that Client in connection with the relevant engagement. Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless Pantai Emas, its directors, employees, and agents from and against any claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your conduct in relation to a property viewing or tenancy.

11. Termination

Either party may terminate an engagement by written notice. Pantai Emas reserves the right to suspend access to the Site or to decline to continue an engagement if these Terms are breached or if we have reasonable grounds to believe that fraudulent or unlawful conduct is involved. Obligations arising before termination, including outstanding fee payments, survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms or our services shall first be referred to informal resolution through direct negotiation. If not resolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

13. General Provisions

These Terms constitute the entire agreement between you and Pantai Emas in relation to their subject matter and supersede all prior agreements. If any provision is found invalid or unenforceable, the remaining provisions continue in full force. No waiver of any right constitutes a continuing waiver. You may not assign your rights under these Terms without written consent. Pantai Emas may update the Site structure and service offering without notice.

14. Changes to These Terms

We may revise these Terms from time to time. The revised Terms will be posted on this page with the updated effective date. Material changes will be communicated via the Site. Continued use of the Site or services following such notice constitutes your acceptance of the updated Terms.
